T-Mobile “FIFA World Cup™ Pick & Win” Sweepstakes

 

1.      NO PURCHASE NECESSARY TO ENTER OR WIN OR INCREASE CHANCES OF WINNING. The T-Mobile “FIFA Pick & Win” Sweepstakes ("Sweepstakes") begins at 12:00:01 AM Eastern Time ("ET") on Tuesday, May 16, 2006 and ends at 11:59:59 PM ET on Sunday, July 9, 2006 (the “Promotion Period”).

 

2.       ELIGIBILITY: Sweepstakes open only to legal residents of the 50 United States, residing in the 50 United States and the District of Columbia (excluding Puerto Rico and all other territories and possessions).  Entrants must be 16 years of age or older at the time of Sweepstakes registration. Employees, officers and directors of T-Mobile USA, Inc ("Sponsor"), RealTime Media, Inc. (collectively, “Sweepstakes Entities”), their affiliates, sales representatives, retailers, dealers, sub-dealers, Sweepstakes and advertising agencies (including, without limitation, Wasserman Media Group), contractors and any others engaged in the sale of T-Mobile services/products or development, production or distribution of game materials, including each of their respective immediate families (spouse, and parents, children, and siblings, and each of their respective spouses, regardless of residence) and persons living in the same household (regardless of whether related) as any of these individuals (together, "Employee Entries") are not eligible to participate in the Sweepstakes. By entering the Sweepstakes, participants agree to release, discharge and hold harmless Sweepstakes Entities, their respective parents, affiliates, subsidiaries, retailers, agencies and their respective officers, directors, employees and agents, from any and all liability, claims, judgments, losses, injuries, demands, damages, actions, and /or causes of actions, whether direct or indirect, which may be due to or arise out of participation in the Sweepstakes or any portion thereof, or the acceptance, use/misuse or possession of prizes. The Official Rules and the decisions of the independent judges (RealTime Media, Inc.) are final and binding in all respects.  Void in Puerto Rico, all other U.S. territories and possessions, and where prohibited by law, rule or regulation.  All federal, state and local laws and regulations apply.

 

3.       HOW TO ENTER:  No purchase necessary to play. LIMIT: One (1) sweepstakes entry per person, per phone number or per email address, per day of FIFA World Cup games competition during the Promotion Period, regardless of the chosen entry method. The Sweepstakes entry methods and all applicable entry periods are defined below.

3a.) Entry Methods:  There are two (2) entry methods available, as defined below:

 

i.) Online Entry Method:  LIMIT: One (1) online entry per person or email address per day of FIFA World Cup games competition during the Promotion Period. Subsequent entries from the same person or email address on the same day of FIFA World Cup games competition will be disqualified. Any attempt by a person to use multiple email accounts to enter more times than is allowed by these Rules may result in disqualification, at the discretion of the judges or Sponsors.  To enter the Sweepstakes online, the participant must go to the following Web site address during the Promotion Period:  http://www.T-MobileWorldCup2006.com, and follow the links to the “FIFA World Cup Pick & Win” Sweepstakes Splash Page. Once on the Splash page, the participant must select -- from the available choices -- the potential result of the FIFA World Cup game that is displayed for that day of FIFA World Cup games competition. The participant then must submit such selection, by clicking on the “Select” button, within the applicable “Entry Period” that is specified for that game in the chart contained in Section 3(b) below.

All first-time participants in the Sweepstakes will be required to fill out a registration form. The participant must complete the entry form truthfully and correctly with all of the requested information, and the participant then must click on the “Submit” button.  Subject to the daily entry limitation set forth in the first sentence of this subparagraph 3(a)(i), each such on-line entry form so completed, and associated with a correct game result selection submitted during the applicable Entry Period therefor, shall count as one (1) Sweepstakes entry. The participant will be awarded a Sweepstakes entry only if the correct game result was selected. The participant will not be awarded a Sweepstakes entry if an incorrect game result was selected.   

Returning participants in the Sweepstakes will be able to login to the site with First Name, Last Name and Email Address to select game results on subsequent days of FIFA World Cup games competition.

 

If the participant is a T-Mobile customer, he/she also can earn Sweepstakes entries via the following additional entry method:

 

ii.) SMS Text Messaging Entry Method:  LIMIT: One (1) SMS entry per person, per phone number per day of FIFA World Cup games competition during the Promotion Period.  Subsequent entries from the same person or handset device on the same day of FIFA World Cup games competition will be disqualified. A T-Mobile customer can use his/her handset device to enter by text message by sending the keyword “WIN” to the SMS shortcode 2006. Subject to the daily entry limitation set forth in the first sentence of this subparagraph 3(a)(ii), each such text message containing the correct game result selection and successfully received during the applicable Entry Period therefor, shall count as one (1) Sweepstakes entry. T-Mobile’s standard text messaging charges do not apply to each entry so submitted and to each entry confirmation received by text message for this Sweepstakes.

 

3b). Entry Periods: The following list of FIFA World Cup matches will be available for participants to select a game result and potentially be awarded a sweepstakes entry:

 

 

Sweepstakes entries will be deemed made by the authorized account holder of the cellular phone number or email address (if and as applicable) submitted at time of entry. The authorized account holder of an email address is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses or the domain associated with the submitted email address. The authorized account holder of a cellular phone number is defined as the natural person who is assigned the cellular phone number by a cellular service provider or other organization that is responsible for assigning cellular phone number.  A potential prize recipient must provide Sponsor with satisfactory proof that he/she is the authorized account holder of the cellular phone number or email address (if and as applicable) associated with the potentially prize-receiving entry.  In the case of a minor, the winner’s parent or legal guardian may be the authorized account holder. Entries generated by a script, macro or other automated means will be disqualified. Entries that are incomplete, illegible or corrupted are void and will not be accepted.  Information collected from the entrant is used only for the purpose of the prize drawing and notification of potential prize recipients, and such information will not be re-used, sold or shared in any manner by Sweepstakes Entities or any third parties unless the entrant has elected to receive additional information and promotional material from Sponsor or a third party. Once the Sweepstakes has ended, all information supplied by entrants will be removed from the database.  By entering the Sweepstakes, the entrant agrees to all of the terms and conditions of the Sponsor’s Privacy Policy, which is available at http://www.t-mobile.com/info/legal/privacy.asp.

 

 

4.       SWEEPSTAKES DRAWING AND PRIZES: Based on the end date of the applicable Entry Period therefor, each eligible Sweepstakes entry submitted hereunder will be grouped into one (1) of a total of six (6) Sweepstakes periods, the dates for each of which are set forth below. On that date which is approximately three (3) to five (5) days after the conclusion of each such Sweepstakes period, five hundred twenty (520) potential prize recipients will be selected in an electronic randomized drawing among all eligible entries received on a timely basis (i.e., within the applicable time periods set forth in Paragraph 3(b) above) for that period. At the conclusion of the Sweepstakes, a “Grand Prize” (as defined below) drawing will also be held to select one (1) potential Grand Prize recipient among all eligible entries received on a timely basis (i.e., within the applicable time periods set forth in Paragraph 3(b) above) throughout the entire Promotion Period. Non-selected entries will be rolled into subsequent Sweepstakes period drawings. The Sweepstakes period dates, prize quantities, prize descriptions, prize approximate retail values (“ARV”s), and presently scheduled drawing dates for each such drawing are as follows:

 

Period One: May 16, 2006 – June 16, 2006 (Group Matches).

o        First Place (1):  One Thousand Dollar ($1,000) cash prize, payable to the potential prize recipient in the form of a check.

o        Second Place (1): Official T-Mobile FIFA World Cup Foosball Table, ARV $300.00.

o        Third Place (3): T-Mobile Service Package, including one (1) wireless phone (the manufacturer and model of which shall be chosen by Sponsor) and three (3) months of wireless phone service (the terms and restrictions of which shall be determined by Sponsor), ARV $290.00 each.

o        Fourth Place (5): Philips 7” Portable DVD Player, ARV $180.00 each.

o        Fifth Place (10): Philips 2GB MP3 Player, ARV $175.00 each.

o        Sixth Place (200): Official T-Mobile FIFA World Cup Fleece Sweater & Cap, ARV $17.00 each.

o        Seventh Place (300): Official T-Mobile FIFA World Cup Sportbag & Soccer Ball, ARV $18.00 each.

·         Period One Drawing will be held on or about June 20, 2006.

 

Period Two: June 17, 2006 – June 23, 2006 (Group Matches).

·         Period Two Prizes:

o        First Place (1):  One Thousand Dollar ($1,000) cash prize, payable to the potential prize recipient in the form of a check.

o        Second Place (1): Official T-Mobile FIFA World Cup Foosball Table, ARV $300.00.

o        Third Place (3): T-Mobile Service Package, including one (1) wireless phone (the manufacturer and model of which shall be chosen by Sponsor) and three (3) months of wireless phone service (the terms and restrictions of which shall be determined by Sponsor), ARV $290.00 each.

o        Fourth Place (5): Philips 7” Portable DVD Player, ARV $180.00 each.

o        Fifth Place (10): Philips 2GB MP3 Player, ARV $175.00 each.

o        Sixth Place (200): Official T-Mobile FIFA World Cup Fleece Sweater & Cap, ARV $17.00 each.

o        Seventh Place (300): Official T-Mobile FIFA World Cup Sportbag & Soccer Ball, ARV $18.00 each.

·         Period Two Drawing will be held on or about June 27, 2006.

 

Period Three: June 24, 2006 – June 27, 2006 (Rounds of Sixteen).

·         Period Three Prizes:

o        First Place (1):  One Thousand Dollar ($1,000) cash prize, payable to the potential prize recipient in the form of a check.

o        Second Place (1): Official T-Mobile FIFA World Cup Foosball Table, ARV $300.00.

o        Third Place (3): T-Mobile Service Package, including one (1) wireless phone (the manufacturer and model of which shall be chosen by Sponsor) and three (3) months of wireless phone service (the terms and restrictions of which shall be determined by Sponsor), ARV $290.00 each.

o        Fourth Place (5): Philips 7” Portable DVD Player, ARV $180.00 each.

o        Fifth Place (10): Philips 2GB MP3 Player, ARV $175.00 each.

o        Sixth Place (200): Official T-Mobile FIFA World Cup Fleece Sweater & Cap, ARV $17.00 each.

o        Seventh Place (300): Official T-Mobile FIFA World Cup Sportbag & Soccer Ball, ARV $18.00 each.

·         Period Three Drawing will be held on or about June 30, 2006.

 

Period Four: June 30, 2006 – July 1, 2006 (Quarter Finals).

·         Period Four Prizes:

o        First Place (1):  One Thousand Dollar ($1,000) cash prize, payable to the potential prize recipient in the form of a check.

o        Second Place (1): Official T-Mobile FIFA World Cup Foosball Table, ARV $300.00.

o        Third Place (3): T-Mobile Service Package, including one (1) wireless phone (the manufacturer and model of which shall be chosen by Sponsor) and three (3) months of wireless phone service (the terms and restrictions of which shall be determined by Sponsor), ARV $290.00 each.

o        Fourth Place (5): Philips 7” Portable DVD Player, ARV $180.00 each.

o        Fifth Place (10): Philips 2GB MP3 Player, ARV $175.00 each.

o        Sixth Place (200): Official T-Mobile FIFA World Cup Fleece Sweater & Cap, ARV $17.00 each.

o        Seventh Place (300): Official T-Mobile FIFA World Cup Sportbag & Soccer Ball, ARV $18.00 each.

·         Period Four Drawing will be held on or about July 6, 2006.

 

Period Five: July 4, 2006 – July 5, 2006 (Semi Finals)  

·         Period Five Prizes:

o        First Place (1):  One Thousand Dollar ($1,000) cash prize, payable to the potential prize recipient in the form of a check.

o        Second Place (1): Official T-Mobile FIFA World Cup Foosball Table, ARV $300.00.

o        Third Place (3): T-Mobile Service Package, including one (1) wireless phone (the manufacturer and model of which shall be chosen by Sponsor) and three (3) months of wireless phone service (the terms and restrictions of which shall be determined by Sponsor), ARV $290.00 each.

o        Fourth Place (5): Philips 7” Portable DVD Player, ARV $180.00 each.

o        Fifth Place (10): Philips 2GB MP3 Player, ARV $175.00 each.

o        Sixth Place (200): Official T-Mobile FIFA World Cup Fleece Sweater & Cap, ARV $17.00 each.

o        Seventh Place (300): Official T-Mobile FIFA World Cup Sportbag & Soccer Ball, ARV $18.00 each.

·         Period Five Drawing will be held on or about July 10, 2006.

 

Period Six: July 8, 2006 – July 9, 2006 (3rd Place & Final)

·         Period Six Prizes:

o        First Place (1):  One Thousand Dollar ($1,000) cash prize, payable to the potential prize recipient in the form of a check.

o        Second Place (1): Official T-Mobile FIFA World Cup Foosball Table, ARV $300.00.

o        Third Place (3): T-Mobile Service Package, including one (1) wireless phone (the manufacturer and model of which shall be chosen by Sponsor) and three (3) months of wireless phone service (the terms and restrictions of which shall be determined by Sponsor), ARV $290.00 each.

o        Fourth Place (5): Philips 7” Portable DVD Player, ARV $180.00 each.

o        Fifth Place (10): Philips 2GB MP3 Player, ARV $175.00 each.

o        Sixth Place (200): Official T-Mobile FIFA World Cup Fleece Sweater & Cap, ARV $17.00 each.

o        Seventh Place (300): Official T-Mobile FIFA World Cup Sportbag & Soccer Ball, ARV $18.00 each.

·         Period Six Drawing will be held on or about July 12, 2006.

 

Grand Prize:  One (1) potential “Grand Prize” recipient will be selected on or about July 12, 2006 to receive a Twenty-Five Thousand Dollar ($25,000) cash prize (the “Grand Prize”). The Grand Prize will be awarded in the form of a check payable to the actual Grand Prize recipient and will be sent to the actual Grand Prize recipient’s address, as provided, via insured mail.

 

 

The total ARV of all prizes is One Hundred Six Thousand Seven Hundred Twenty Dollars ($106,720).

 

IN THE EVENT OF PRIZE UNAVAILABILITY, ANY PRIZE LISTED ABOVE IN THIS PARAGRAPH 4 MAY BE SUBSTITUTED BY SWEEPSTAKES ENTITIES, IN THEIR SOLE DISCRETION, FOR ITEMS OF EQUAL OR GREATER ARV.

 

 

5.       PRIZE AWARDING: Limit of one (1) weekly prize and one (1) Grand Prize per household. Prizes will only be awarded upon potential prize recipients’ verification and final approval by Sponsor. No prize substitution, cash equivalent of prizes, transfer or assignment of prize permitted, except by Sponsor in its sole discretion, due to prize unavailability for any reason, and then only for a prize of equal or greater value. If the recipient of any prize is a minor, the prize will be awarded to the parent or legal guardian.     Potential recipients of any prizes valued below $600.00 will receive prize notification via electronic mail, United States Postal Mail and/or overnight mail. Subject to the subsequent rescheduling of any World Cup match(es) to a later date(s), all prizes will be fulfilled 6 to 8 weeks after the last day of the month in which the recipient of that prize has been verified.  If the potential prize recipient of any prize cannot be contacted; is ineligible; fails to claim the prize; if the Prize Notification is returned undeliverable; or if the potential prize recipient otherwise fails to fully comply with these Official Rules, he/she will forfeit that prize and the prize will not be awarded.

Potential prize recipients of any prizes valued above $600 will receive notification that he/she has been selected via electronic mail and phone and will have three (3) days from receipt of selection notification to confirm that the notification has been received or an alternate potential prize recipient will be selected. After confirming notification receipt, the potential prize recipient will be sent via United States Postal Mail and/or overnight mail an Affidavit of Eligibility/Compliance & Publicity/Liability Release forms, and a W-9 form. These forms must be completed, signed, notarized and returned to RealTime Media within three (3) days. The potential prize recipient then, and only then, becomes the “actual” prize recipient.  If the potential recipient of the any prize valued above $600 cannot be contacted; is ineligible; fails to return the completed and executed Affidavit and Release; fails to claim the prize; if the Prize Notification is returned undeliverable; or if the potential prize recipient otherwise fails to fully comply with these Official Rules, he/she will forfeit that prize, and the prize will be awarded by means of another random drawing among all other eligible Sweepstakes entrants during the period at issue, to an alternate potential prize recipient. Each actual prize recipient grants Sponsor the right to use and publish his/her proper name and State of residence and to use his/her name and likeness solely for advertising and promotional purposes for this Sweepstakes, without notice or further compensation, except where prohibited by law. All information collected will be treated in a manner consistent with Sponsor’s privacy policy. All decisions of the judges shall be binding and final.

 

No prize substitution, cash equivalent of prize, transfer or assignment of prize permitted, except by Sponsor, who reserves the right, in its sole discretion, to substitute a prize with another prize of greater or equal value in the event that a prize or portion of prize is unavailable.  Each actual prize recipient is responsible for all applicable local, state and federal taxes.

 

6.       DISQUALIFICATION: Sweepstakes Entities are not responsible for technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware, software or web site.  Sweepstakes Entities are not responsible for lost, interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer or telephone transmissions or technical failure, jumbled, scrambled or misdirected transmissions, for incorrect or inaccurate entry information, howsoever caused, or other error of any kind whether human, mechanical or electronic. Entrants found tampering with or abusing any aspect of this Sweepstakes, as solely determined by the judges, will be disqualified. If disqualified for any of the above abuses, Sponsor reserves the right to terminate entrant's eligibility to participate in the Sweepstakes.  Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be in violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right (among other causes of action and remedies) to seek damages from any such person to the fullest extent permitted by law.  Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.  Sponsor reserves the right to terminate, cancel, suspend and/or modify the Sweepstakes if any fraud, virus or other technical problem corrupts the administration, security, safety or proper play of the Sweepstakes, as determined by Sponsor in its sole discretion.  In such event, Sponsor reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right to award only the number of prizes stated in the Official Rules for that category. In no event will more prizes be awarded than those listed in Rule #4. 

 

7.       TAX INFORMATION: All applicable federal, state, local, and other taxes on prizes are the sole responsibility of the applicable actual prize recipient.   

 

8.       GENERAL INFORMATION: Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed exclusively by, and construed exclusively in accordance with, (a) the laws of the State of Washington (without giving effect to any choice of law or conflict of law rules, whether of the State of Washington or of any other jurisdiction, which would cause the application of the laws of any jurisdiction other than the State of Washington) and (b) the federal laws of the United States of America.

 

9.       PRIZE RECIPIENTS LIST: To receive a list of actual prize recipients, send a self-addressed stamped #10 envelope for receipt by September 2, 2006 to T-Mobile “FIFA World Cup Pick & Win” Sweepstakes Prize Recipients List Request, c/o RealTime Media, 295 E Swedesford Road, PMB#104, Wayne, PA 19087.  Residents of the State of Vermont may omit return postage.
